This page, together with the documents referred to on it, tells you the terms and conditions (these Terms and Conditions) on which we supply any of the products (each a Product) or an accessory (Accessory) listed on our website www.pfaff-australia.com.au (hereinafter referred to as “our Website”) to you. Please read these terms and conditions carefully before ordering any Products from the Website. You should understand that by ordering any of our Products, you agree to be bound by these terms and conditions. We recommend you print a copy of these Terms and Conditions for future reference.

Introduction

References to “we”, “us” or “our” are references to Blessington Pty Limited, ABN 71 083 060 271, Unit 17, 167 Prospect Highway, Seven Hills NSW 2747, Australia, (authorised distributor for SVP Worldwide) and trading as PFAFF, www.pfaff-australia.com.au, and its subsidiaries, associates and officers, unless otherwise stated. These Terms and Conditions govern the supply by us of any Product ordered by you on the Website. By agreeing to order a Product, you agree to be legally bound by these Terms and Conditions. In these Terms and Conditions: No changes to the Terms and Conditions shall be binding unless agreed in writing signed by us.

Legal Capacity to transact

By accepting these Terms and Conditions you acknowledge that you are over the age of eighteen (18) years. If you are under the age eighteen (18) years you cannot place orders on our Website. Blessington reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused any order(s) to be placed with Blessington on the Website.

Australian Sales Only

We only sell and ship products within Australia. We will not make deliveries outside of Australia.

Placing An Order

You may place an Order by adding items to ‘My Cart’ on the Website and clicking the “Check Out” button. When you place your Order, we will issue you with an Order Number on a “Thank you for Your Order” email. By placing an Order, you make an offer to us to purchase the Products you have selected based on these Terms and Conditions. The “Thank You” email does not guarantee we formally accept your offer until your order has passed our internal validation procedures for verifying the bona fides of each order placed, for the purpose of preventing credit card or payment fraud. We will confirm acceptance of your order when your order status moves to dispatched in the My Account My Orders Section. If we cannot process or accept your Order after payment is received we will contact you by email or telephone. Any products purchased from our Website are for personal use only and not for commercial use as per our Warranty. For high value and bulky items your purchases may need to be verified by provision of identification for insurance and freight purposes, in which case a sales consultant will be in touch.

Payment Methods

The Website uses EWAY to provide a secure environment for the authorisation of credit card and charge card transactions. We also offer PayPal and AfterPay payment solutions. Blessington’s policy is to confirm the identity of the purchaser for any order over $1,000 by requesting photo ID be provided before the order is dispatched. Confidential information including card details are encrypted using industry standard SSL 256-bit encryption technology.

Prices

Blessington reserves the right to change prices for Products displayed on website at any time. We reserve the right to correct any errors in pricing update information on the website at any time (including after you have submitted your order). Should the pricing be incorrect on your order we will contact via phone or email before proceeding. All prices are in Australian Dollars and are inclusive of GST, where applicable.

Delivery / Shipping

Delivery will be made via a number of partners and the estimated delivery times will be indicated depending on your location. We use the best possible estimated dates given the information we have been provided by our suppliers and partners, however many factors are outside of our control and we cannot guarantee delivery within this time frame. Individual order status can be tracked in the My Account, My Orders section. We charge shipping and handling for each sale you purchase from unless otherwise stated on the website. We deliver across Australia but are unable to deliver to Islands, PO Boxes, Parcel Lockers or Post Offices. If delivery cannot be made to an address and the product returned to our warehouse, the Customer will be liable to pay a re-delivery fee. Blessington will not be liable to you for a loss you, or any third party suffers for a delay or failure to process your Order or deliver Goods due to inaccurate or incomplete details provided in an Order.

Authority to Leave

All orders must be signed for unless you have given specific Authority to Leave instructions. Please ensure there is someone available at the delivery address to sign for the delivery. Blessington and the couriers associated with the delivery, do not accept responsibility for any loss or damage which results from the Authority To Leave delivery method. You agree to release Blessington Pty Ltd from and against any and all claims, demands, liabilities, losses, costs and expenses if Authority To Leave is selected. If delivery cannot be made to an address and the product returned to our warehouse, the Customer will be liable to pay a re-delivery fee.

Cancellation

Blessington may cancel an Order if the Product or Accessory is not available for any reason. We will notify you if this is the case and return any payment that you have made. Cancellations will be made using the same method payment was accepted, unless notified. If you wish to cancel your order please contact our Customer Service on (02) 8811 1900. Once an order has been dispatched it may not be cancelled and the item must instead be returned to the company according to guidelines on our Returns Policy. Blessington may cancel an order if our policy is not met and fraud is suspected. Photo ID must be provided for any order over $1,000 to be dispatched.

Vouchers

Each ‘PFAFF Australia Voucher’ is personal to the User receiving it, is not transferable, has no monetary value and under no circumstances can it be converted into currency. Each ‘PFAFF Australia Voucher’ has an expiry date which cannot be modified. Some ‘PFAFF Australia Voucher’s may specify a minimum spend in order to be used. In this case, the monetary value of the order (excluding delivery costs) has to be higher than the minimum spend. Under no circumstances can the value of a discount ‘PFAFF Australia Voucher’ be deducted from an order if that ‘PFAFF Australia Voucher’ is defective or out of date: no replacement ‘PFAFF Australia Voucher’s will be issued. When an order is placed using a discount ‘PFAFF Australia Voucher’ and it contains a number of items, the value of the discount is spread over each item according to the pro-rated value of that item. Any refund of an item bought in such an order will be reduced by the value of discount attached to it. All ‘PFAFF Australia Vouchers’ will be issued by Blessington Pty Limited.

PFAFF Australia eGift Card

    1. Definition: In these Terms & Conditions, "eGift Card" refers to PFAFF branded gift cards that can only be used for online purchases at www.pfaff-australia.com.au.
    1. Redemption: The eGift Card entitles the holder to goods/services equivalent to the stated value on the card or the remaining balance after partial redemption.
    1. Usage: eGift Cards can only be redeemed for purchases made exclusively on the PFAFF Australia online store at www.pfaff-australia.com.au.
    1. Non-Exchangeable: eGift Cards cannot be exchanged (fully or partially) for cash.
    1. Partial Redemption: eGift Cards are partially redeemable. Any unused balance will remain on the eGift Card and cannot be redeemed for cash.
    1. Excess Amount: If the order value exceeds the eGift Card amount, the holder must pay the price difference between the eGift Card value and the retail price of the goods/services.
    1. No Expiry: All eGift Cards issued by PFAFF Australia do not expire and can be redeemed at any time, unless otherwise specified.
    1. Fraud Prevention: PFAFF Australia reserves the right to refuse to redeem or cancel the redemption of an eGift Card in case of suspected fraud, acting reasonably and in good faith.
    1. Lost or Stolen Cards: PFAFF Australia is not liable for lost or stolen eGift Cards. Please contact PFAFF Australia immediately if your eGift Card is lost or stolen. Replacement of lost or stolen eGift Cards is at PFAFF Australia's discretion, subject to satisfactory proof of purchase and non-redemption of the card.

Correction of Errors

Whilst Blessington makes every reasonable effort to present accurate information on this website, the information may contain typographical errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information on the website at any time (including after you have submitted your order).

Force Majeure

Blessington shall not be liable to you for any breach, hindrance or delay in the performance of a Order attributable to any cause beyond our reasonable control, including without limitation any natural disaster and unavoidable incident, actions of third parties (including without limitation hackers, suppliers, governments, quasi-governmental, supra-national or local authorities), insurrection, riot, civil commotion, war, hostilities, warlike operations, national emergencies, terrorism, piracy, arrests, restraints or detainments of any competent authority, strikes or combinations or lock-out of workmen, epidemic, fire, explosion, storm, flood, drought, weather conditions, earthquake, natural disaster, accident, mechanical breakdown, third party software, failure or problems with public utility supplies (including electrical, telecoms or Internet failure), shortage of or inability to obtain supplies, materials, equipment or transportation (“Event of Force Majeure”), regardless of whether the circumstances in question could have been foreseen. Either you or we may terminate an Order forthwith by written notice to the other in the event that the Event of Force Majeure lasts for a period of two Business Days or more, in which event neither you nor we shall be liable to the other by reason of such termination (other than for the refund of a Product already paid for by you and not delivered).

The contents of the website are protected by copyright, trademark and other intellectual property laws. This website and all materials available on the website are the property of Blessington Pty Limited, or have been authorised by SVP Worldwide and/or its affiliates or licensors

Our Liability

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. You may also be entitled to remedies that cannot be excluded under the Australian Consumer Law if any services supplied by us fail to meet a consumer guarantee under the Australian Consumer Law.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Australia and shall be subject to the non-exclusive jurisdiction of the courts of Australia. Your transaction is deemed to have taken place in Seven Hills, NSW 2747 Australia.
